When viewing, you will be able to readily see that policies of insurance have various degrees of how to pursue the neutral process to resolve a claim that is not fully addressed while it is in the actual claim process.  


If an insured has suffered a claim that is not properly assessed and paid correctly, to see the method of moving forward for a resolution with closure you can look at the various options contained within one’s own Insurance Policy. One can see by the differing examples, that various options are available to settle an underpaid insurance claim.


For example:


1. Mediation  (2017 Florida State Statute §627.7015)  is available as a no cost option, except as otherwise provided in the declarations for the Insured. Mediation was established by the State of Florida, Department of Financial Services back during 1992's devastating Hurricane Andrew. A review of the attached Citizens Property Insurance Corporation notes either party may seek this mediation process. It is a free program in that the insurance company must pay the fees for, and there is no cost to the named insured to attend any mediation proceedings. This is a free process involving you and your claim documentation that can be discussed, and possibly settled in a non-binding process. So, in other words, if you do not prevail on your disputed claim in mediation, there now becomes a next level. C.S.I. can assist insured’s with their mediation questions and also on how to properly present to a Mediator and also the carrier’s named representative. Having the proper documentation is the key to success.  


2. Appraisal is an alternative dispute resolution method that will address and resolve disagreements regarding the amount of loss that is established in the neutral process involving 3 independent parties. The carrier hires a competent Appraiser, the named insured hires their competent Appraiser, and then a 3rd neutral decision maker, known as an Umpire will be chosen. The policy language is specific as to the process, and also some of the policy language will advise that the Appraisers must also be independent or disinterested. This creates the neutral process of having possibly 3 people that have never been to a property loss before to settle the disputed differences. Appraisal is a way of settling a disputed claim matter where 2 out of 3 signatures on an appraisal award form will make the process complete and final.


3. Having to consult with, and possibly hiring, an attorney to represent you may be another option to consider.

In hiring any expert to assist you, it is best to know of all costs related once counsel becomes involved. Sometimes Carriers will engage the Appraisal process and sometimes the home or business owner will engage counsel to “compel” the appraisal process. In any event, always know your costs involved when moving forward in any of the disputed processes available outside of the claim handling process.
